12. Commercial, Industrial, Government, Multi-Unit, and Managed Properties
For commercial, industrial, government, healthcare, hospitality, high-rise, multi-unit, condominium, apartment, municipal, school, institutional, retail, restaurant, office, warehouse, and managed properties, service may require additional coordination.
You are responsible for notifying Blue Works of all relevant property rules, access restrictions, insurance requirements, safety requirements, certificate requirements, background check requirements, security rules, quiet hours, tenant notification requirements, shutdown windows, roof access requirements, loading dock rules, elevator rules, parking rules, union requirements, purchasing rules, and other site-specific conditions before work is scheduled.
Blue Works may decline, pause, reschedule, reprice, or condition service if site conditions, access conditions, safety conditions, authorization issues, or customer-provided information differ from what was represented.
13. Customer Authorization
By requesting service, you represent that you are the property owner, authorized representative, tenant with authority, facility manager, project manager, purchasing agent, board representative, general contractor, property manager, or other person with legal authority to request the work.
You agree to indemnify and hold Blue Works harmless from claims, losses, disputes, access issues, payment disputes, property disputes, ownership disputes, tenant disputes, management disputes, or authority disputes arising from your lack of authority or inaccurate representations.
14. Access to Property
You are responsible for providing safe, reasonable, and timely access to the property, equipment, roof areas, mechanical rooms, electrical panels, water sources, drains, ceilings, walls, crawlspaces, parking areas, loading areas, tenant spaces, and other work areas required for inspection, diagnosis, service, repair, replacement, or installation.
Blue Works may charge for delays, return trips, inaccessible equipment, locked areas, missed appointments, failed access, unsafe conditions, incomplete shutdown preparation, or other customer-caused scheduling inefficiencies, where permitted by the applicable proposal, agreement, or law.
15. Site Conditions and Hidden Conditions
Existing buildings and mechanical systems may contain hidden, concealed, deteriorated, damaged, unsafe, non-code-compliant, improperly installed, previously modified, inaccessible, or unknown conditions. These may include but are not limited to concealed leaks, electrical defects, structural issues, roofing defects, drain restrictions, mold-like growth, corrosion, insulation damage, duct leakage, improper prior repairs, equipment defects, refrigerant leaks, control failures, collapsed piping, damaged supports, abandoned lines, or code deficiencies.
Blue Works is not responsible for hidden or pre-existing conditions unless expressly agreed in writing. Discovery of hidden conditions may require additional work, additional charges, schedule changes, revised recommendations, third-party specialists, engineering review, permit revisions, customer approvals, or project suspension.
16. Existing Equipment and System Performance
Blue Works may service, repair, inspect, maintain, replace, or recommend changes to existing equipment or systems. Existing systems may fail, degrade, leak, stop operating, or reveal additional problems during or after inspection, maintenance, cleaning, repair, or startup.
Unless expressly stated in a written warranty or agreement, Blue Works does not guarantee the future performance, capacity, efficiency, lifespan, energy cost, indoor comfort level, humidity level, airflow balance, or reliability of existing equipment or systems.
Recommendations made by Blue Works are based on available information at the time of inspection or service. Conditions may change, and additional problems may become visible only after work begins or after equipment is operated under load.
17. Manufacturer Warranties and Third-Party Products
Equipment, parts, controls, materials, and components may be subject to manufacturer warranties, distributor terms, registration requirements, maintenance requirements, installation conditions, exclusions, and limitations.
Blue Works does not control manufacturer warranty decisions, manufacturer processing times, parts availability, discontinued products, warranty approvals, warranty denials, manufacturer labor exclusions, shipping delays, distributor delays, or changes in third-party product terms.
Any manufacturer warranty is separate from any written workmanship warranty issued by Blue Works. Warranty coverage must be confirmed in writing and may be subject to exclusions, maintenance obligations, misuse exclusions, access requirements, payment status, and other conditions.

Blue Works may refuse, pause, or stop work if conditions are unsafe or unsuitable. Unsafe conditions may include but are not limited to electrical hazards, gas hazards, roof hazards, confined space hazards, biological hazards, sewage exposure, aggressive animals, blocked access, structural instability, weather hazards, violence, harassment, illegal activity, hazardous materials, or lack of required site control.
You agree to provide a safe work environment, disclose known hazards, secure pets, provide required access, notify occupants as needed, and cooperate with reasonable safety requirements.

If suspected hazardous or regulated materials are encountered, work may need to stop until proper testing, remediation, abatement, or clearance is performed by qualified parties.
33. Limitation of Liability
To the fullest extent permitted by law, Blue Works, its owners, officers, managers, employees, contractors, subcontractors, vendors, licensors, affiliates, and representatives shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, speculative, or enhanced damages arising from or related to your use of this website, reliance on website content, inability to access the website, service inquiries, scheduling issues, or website communications.
